Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This notice applies to care provided by EMERGILITY® EMS, a Virginia OEMS-licensed EMS Agency (#50537), including Paramedicine, Mobile Integrated Healthcare and Protective Medicine. We are required by law to maintain the privacy of your protected health information (PHI), to give you this notice of our legal duties and privacy practices, to follow the notice currently in effect, and to notify you if a breach of your unsecured PHI occurs.

How we may use and disclose your health information

• Treatment: to provide, coordinate and manage your care. This includes sharing information with your physicians, hospitals, specialists and other providers involved in your care.
• Payment: to bill and collect for services, including from you or someone who has agreed to pay on your behalf.
• Health care operations: to run our practice, including quality review, training, credentialing, and oversight by our Operational Medical Director.
• Business associates: to vendors who perform services for us, such as billing, records or legal services, under written agreements that require them to protect your information.
• Individuals involved in your care: to a family member, legally authorized representative or other person you identify, as it relates to your care or payment, unless you object.

Other uses and disclosures permitted or required by law. We may use or disclose your information without your written authorization:

• when required by federal, state or local law;
• for public health activities, such as disease reporting;
• for health oversight, including the Virginia Department of Health and the Virginia Office of Emergency Medical Services;
• to prevent or lessen a serious and imminent threat to the health or safety of a person or the public;
• to report suspected abuse, neglect or domestic violence, as required by law;
• in response to a court order, or a subpoena or other lawful process that meets legal requirements;
• to law enforcement, as required or permitted by law;
• to coroners, medical examiners and funeral directors;
• for organ and tissue donation;
• for workers' compensation;
• for specialized government functions, as required by law;
• to the FDA, for product-related reporting;
• for research, when approved under applicable privacy protections or when the information does not identify you.

Uses that require your written authorization. We will not use or disclose your information for marketing purposes, sell your information, or make any other use not described in this notice without your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already relied on it. Where Virginia law is more protective of your information than federal law, we follow Virginia law.

Your rights. You have the right to:

• Inspect and get a copy of your health information, including an electronic copy. We may charge a reasonable, cost-based fee.
• Request a correction of information you believe is incorrect or incomplete. If we deny your request, you may submit a statement of disagreement.
• Request confidential communications, for example being contacted only at a certain phone number or address. We will accommodate reasonable requests and will not ask why.
• Request restrictions on how we use or share your information. We are not required to agree, except that we must agree not to share information with your health plan about a service you paid for in full out of pocket, unless the law requires it.
• Receive an accounting of certain disclosures we have made.
• Get a paper copy of this notice at any time.
• Choose someone to act for you, such as a legally authorized representative.

Changes to this notice. We may change this notice. Any change will apply to all information we hold, and the current version will always be posted on this page and available on request.

Protective security and private investigations are delivered under EMERGILITY® PSS, a Virginia DCJS-licensed Private Security Services Business (#11-18032).

The personal information of our Protected Clients is held in strict confidence. This includes:

• identities, residences and schedules
• travel itineraries
• security plans and threat assessments
• investigative findings

We share it only:

• with EMERGILITY® personnel who need it to protect you;
• with others you authorize;
• with regulators, such as the Virginia Department of Criminal Justice Services, as required by law;
• in response to valid legal process.

All investigations are conducted lawfully, and investigative reports are provided only to the client who engaged us, unless the law requires otherwise.

For health information, you may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/ocr/complaints or 1-800-368-1019. We will not retaliate against you for filing a complaint.
